Terms of Service

These Terms of Service ("Terms") govern your use of the Gaffon website at gaffon.com and our iOS and Android applications (collectively, the "Service"), operated by Gaffon ("we", "us", or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What Gaffon is

Gaffon is a video-first property listings platform. We display property listings — including video tours, photos, prices, and locations — published by estate agents or drawn from publicly available sources. Gaffon is a listings and discovery service only:

• We are not an estate agent, broker, solicitor, or surveyor, and we are not a party to any property transaction.
• Listings are provided for information. They are not offers, legal particulars, valuations, or advice. Prices, availability, and details can change or contain errors — always verify directly with the listing agent before making any decision.

2. Using the Service

You may browse listings without creating an account. You must be at least 18 years old to create an agent account or publish content. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Scrape, harvest, or bulk-download listings, media, or data from the Service, or access it by automated means except through interfaces we expressly provide.
• Interfere with or disrupt the Service, probe or test its vulnerability, or circumvent any access or rate limits.
• Impersonate any person or agency, or misrepresent your affiliation with a listing or property.
• Upload content that is unlawful, infringing, defamatory, or misleading, or that contains malware.
• Resell, rebrand, or commercially exploit the Service or its content without our written permission.

3. Agent accounts

Estate agents can register for an account to publish and manage listings. If you create an account:

• You are responsible for the accuracy of your account details and for keeping your password secure. Anything done through your account is your responsibility.
• You confirm you are authorised to act for the agency you represent and to market the properties you list.
• Tell us immediately at support@gaffon.com if you suspect unauthorised use of your account.

You can delete your account at any time via our account deletion page.

4. Listings and content you publish

You keep ownership of the content you publish on Gaffon — your videos, photos, descriptions, and other listing material ("Agent Content"). By publishing Agent Content you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example, transcoding video or generating thumbnails), display, and distribute it for the purposes of operating, promoting, and improving the Service. This licence ends when the content is removed from the Service, except where it has already been shared through the Service or is needed for legal compliance.

By publishing Agent Content you warrant that:

• You own it or have all rights needed to publish it — including any music, footage, or images within a video, and consent from any identifiable people appearing in it.
• It is accurate and not misleading in all material respects, including price, description, and availability.
• Publishing it complies with the laws and advertising rules that apply to you as an agent, including consumer-protection and property-marketing regulations.

We may remove, edit, or decline to display any content at our discretion, including in response to a takedown request or a legal obligation.

5. Instagram import

Agents can optionally connect an Instagram professional account to import their own photos into a listing. Your use of that feature is also subject to Meta's terms, and the media you import is treated as Agent Content under these Terms. How we handle Instagram data is described in our Privacy Policy.

6. Reporting a listing

If a listing is yours, incorrect, infringes your rights, or should not be on Gaffon, use the request form on our support page or email support@gaffon.com. Every request is reviewed by a person and we respond before anything changes.

7. Our intellectual property

The Service — including the Gaffon name, logo, design, software, and all content we create — is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.

8. Third-party services and links

The Service may link to or embed third-party content and services (for example, listing agents' websites, map data providers, or social platforms). We are not responsible for third-party content, terms, or practices.

9. Availability and changes

The Service is provided free of charge and we may change, suspend, or discontinue any part of it at any time. We may also update these Terms from time to time; the "Last updated" date above reflects the most recent revision, and material changes will be highlighted in the app or on the website. Continuing to use the Service after a change means you accept the revised Terms.

10. Termination

You can stop using the Service at any time. We may suspend or terminate your access (including any agent account) if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination — including content licences already relied upon, disclaimers, and limitation of liability — survive.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any listing is accurate or current.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, data, goodwill, or opportunity, arising from your use of the Service — including any decision made in reliance on a listing. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence, or for fraud.

13. Indemnity

If you publish Agent Content, you agree to indemnify us against claims, losses, and reasonable costs arising from that content or from your breach of these Terms — for example, a claim that a video you uploaded infringes someone's rights or misdescribes a property.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them or the Service. If you are a consumer, you keep any mandatory protections of the country you live in.
